Fly Water Travel LLC ("Fly Water Travel") acts solely as an agent for the various transportation companies, outfitters, lodges, tour operators, and other travel suppliers named in your itinerary and is, therefore, not responsible for any act, failure, delay, injury, loss or omission in providing their services. Further, Fly Water Travel shall not be responsible for breach of contract of any intentional, negligent or careless actions or omissions on part of such companies, outfitters, lodges, tour operators, and other travel suppliers, which result in any loss, damage, delay, or injury to you or your travel companions or group members. Fly Water Travel maintains no control over the operations, equipment or personnel of any supplier used in conjunction with your travel arrangements. All prices and payment terms are set by individual lodges, outfitters and guides and are subject to change without notice. Fly Water Travel shall not be liable for any loss, injury, or damage resulting directly or indirectly from any acts of God, acts of governments, local laws, terrorist activities, climactic conditions, criminal acts or other authorities, or from any cause beyond the control of this travel agency nor liable for defaults of suppliers or any other person, company or entity not under its control. Fly Water Travel has no special knowledge regarding the financial condition of the suppliers, weather hazards, or climate extremes at locations to which you may travel. You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). For information concerning such requirements and possible dangers at destinations, we recommend contacting the Travel Warnings Section of the U.S. State Department at www.travel.state.gov. For medical information, we recommend contacting the Centers for Disease Control at www.cdc.gov/travel. You hereby release Fly Water Travel from all claims arising out of any problem covered in the foregoing paragraphs. You agree that the courts in Oregon will be the exclusive jurisdiction for all claims brought by you or Fly Water Travel and you hereby submit to the personal jurisdiction of those courts. Any claim or dispute with Fly Water Travel arising out of or relating to this contract or services pursuant to this contract shall be settled by binding arbitration in accordance with the rules then in effect adopted by the American Arbitration Association. Such arbitration shall take place in Oregon, applying Oregon law, without regard to conflicts of laws provisions. A request for arbitration must be filed within six months from your scheduled departure date.
